ব্যবহারের শর্তাবলিTerms and Conditions

এই শর্তাবলি আপনার ও PHM Live এর মধ্যে একটি চুক্তি। অ্যাপটি ডাউনলোড করলে, অ্যাকাউন্ট খুললে বা ব্যবহার করলে ধরে নেওয়া হবে আপনি এই শর্তগুলো পড়েছেন এবং মেনে নিয়েছেন। শর্তে রাজি না থাকলে অনুগ্রহ করে অ্যাপটি ব্যবহার করবেন না। These terms form an agreement between you and PHM Live. By downloading the app, creating an account or using the service, you confirm that you have read and accepted them. If you do not agree, please do not use the app.

১. সংজ্ঞা1. Definitions

• "অ্যাপ" — PHM Live মোবাইল অ্যাপ্লিকেশন এবং phmlive.com ওয়েবসাইট। "App" — the PHM Live mobile application and the phmlive.com website.
• "ব্যবহারকারী" — যিনি অ্যাপে অ্যাকাউন্ট খুলেছেন। "User" — anyone who has an account on the app.
• "হোস্ট" — যিনি লাইভ সম্প্রচার করেন বা আসনে বসে অনুষ্ঠান পরিচালনা করেন। "Host" — a user who broadcasts live or presents from a seat.
• "কয়েন" — অ্যাপের ভেতরে কেনা ভার্চুয়াল একক, যা দিয়ে উপহার পাঠানো যায়। "Coins" — virtual units purchased inside the app, used to send gifts.
• "ডায়মন্ড" — হোস্ট উপহার পেলে যে ভার্চুয়াল একক জমা হয়, যা নির্দিষ্ট হারে উত্তোলনযোগ্য। "Diamonds" — the virtual units a host accrues from gifts received, withdrawable at a published rate.

২. যোগ্যতা ও বয়স2. Eligibility and age

PHM Live ব্যবহার করতে আপনার বয়স অবশ্যই ১৮ বছর বা তার বেশি হতে হবে। অ্যাকাউন্ট খোলার সময় সঠিক জন্মতারিখ দিতে হবে। ভুল বয়স দিয়ে অ্যাকাউন্ট খুললে তা যেকোনো সময় বন্ধ করে দেওয়া হবে এবং জমা থাকা ব্যালেন্স বাতিল হবে। বিস্তারিত শিশু সুরক্ষা মানদণ্ড পাতায় আছে। You must be 18 or over to use PHM Live. You must provide an accurate date of birth at sign-up. Accounts created with a false age will be closed whenever we discover this, and any balance forfeited. See our Child Safety Standards for detail.

আপনার দেশের আইনে এই ধরনের সেবা নিষিদ্ধ হলে অ্যাপটি ব্যবহার করবেন না। স্থানীয় আইন মেনে চলার দায়িত্ব আপনার। Do not use the app if this kind of service is prohibited where you live. Complying with your local laws is your responsibility.

৩. আপনার অ্যাকাউন্ট3. Your account

• অ্যাকাউন্টের নিরাপত্তা রক্ষার দায়িত্ব আপনার। আপনার অ্যাকাউন্ট থেকে যা কিছু ঘটে, তার দায়ও আপনার। Keeping your account secure is your responsibility, as is anything that happens through it.
• OTP বা লগ ইন কোড কাউকে দেবেন না। PHM Live কখনো আপনার কাছে OTP চায় না। Never share your OTP or login code. PHM Live will never ask you for one.
• অ্যাকাউন্ট অন্য কাউকে দেওয়া, ভাড়া দেওয়া, বিক্রি করা বা হস্তান্তর করা যাবে না। Accounts may not be given away, rented, sold or transferred.
• একজন ব্যক্তি একাধিক অ্যাকাউন্ট খুলে অফার, বোনাস বা পুরস্কার একাধিকবার নিতে পারবেন না। One person may not use multiple accounts to claim offers, bonuses or rewards more than once.
• অ্যাকাউন্ট হারিয়ে ফেললে বা অন্য কেউ ব্যবহার করছে বলে সন্দেহ হলে সাথে সাথে আমাদের জানান। Tell us immediately if you lose access to your account or suspect someone else is using it.

৪. আচরণের নিয়ম4. Rules of conduct

অ্যাপে যা করা যাবে না তার পূর্ণ তালিকা কমিউনিটি নির্দেশিকা পাতায় আছে এবং সেটি এই শর্তাবলিরই অংশ। সংক্ষেপে নিষিদ্ধ: The full list of what is not allowed is in our Community Guidelines, which form part of these terms. In summary, the following are prohibited:

• নগ্নতা, যৌন উদ্দীপক আচরণ বা অশ্লীল বিষয়বস্তু সম্প্রচার। Nudity, sexually suggestive behaviour or obscene content.
• শিশু সংক্রান্ত যেকোনো নিপীড়নমূলক বা যৌন বিষয়বস্তু — এতে প্রথমবারেই স্থায়ী নিষেধাজ্ঞা। Any abusive or sexual content involving children — permanent ban on the first instance.
• সহিংসতা, ঘৃণা, ধর্মীয় বা জাতিগত বিদ্বেষ ছড়ানো। Violence, hatred, or religious or ethnic incitement.
• হয়রানি, হুমকি, ব্ল্যাকমেইল বা অন্যের ব্যক্তিগত তথ্য প্রকাশ। Harassment, threats, blackmail, or publishing someone's private information.
• অন্যের পরিচয় বা বিষয়বস্তু নিজের বলে চালানো। Impersonating someone, or passing off another's content as your own.
• জুয়া, মাদক, অস্ত্র বা বেআইনি কিছুর প্রচার ও বেচাকেনা। Promoting or trading gambling, drugs, weapons or anything unlawful.
• অ্যাপের নিরাপত্তা ভাঙার চেষ্টা, স্বয়ংক্রিয় যন্ত্র বা পরিবর্তিত সংস্করণ ব্যবহার। Attempting to breach the app's security, or using bots or modified builds.
• কৃত্রিম উপায়ে কয়েন, ডায়মন্ড, লেভেল বা দর্শক সংখ্যা বাড়ানো। Artificially inflating coins, diamonds, levels or viewer counts.

৫. কয়েন, উপহার ও ডায়মন্ড5. Coins, gifts and diamonds

• কয়েন অ্যাপের ভেতর থেকে ঘোষিত দামে কেনা যায়। কেনা কয়েন সাধারণত ফেরতযোগ্য নয়, তবে প্রযোজ্য ভোক্তা আইন এর ব্যতিক্রম করলে সেটি প্রযোজ্য হবে। Coins are bought inside the app at the published price. Purchased coins are generally non-refundable, except where applicable consumer law requires otherwise.
• উপহার পাঠানো মানে আপনি স্বেচ্ছায় কয়েন খরচ করছেন। পাঠানোর পর তা ফেরত নেওয়া যায় না — ভুল করে পাঠালেও নয়। Sending a gift means you are voluntarily spending coins. A gift cannot be taken back once sent — including if you sent it by mistake.
• হোস্ট উপহার পেলে ঘোষিত হারে ডায়মন্ড জমা হয়। এই হার আমরা আগাম নোটিশ দিয়ে বদলাতে পারি। Hosts accrue diamonds from gifts at the published rate. We may change that rate with prior notice.
• কয়েন বা ডায়মন্ড অ্যাপের বাইরে বেচাকেনা করা যাবে না। এমন করলে অ্যাকাউন্ট বন্ধ হয়ে যাবে। Coins and diamonds may not be traded outside the app. Doing so results in account closure.
• প্রতারণা বা কৃত্রিম উপায়ে অর্জিত ব্যালেন্স বাতিল করার অধিকার আমাদের থাকবে। We reserve the right to void any balance obtained through fraud or artificial means.

৬. হোস্টের আয় ও উত্তোলন6. Host earnings and withdrawal

• অ্যাপে ঘোষিত ন্যূনতম পরিমাণ জমা হলে উত্তোলনের অনুরোধ করা যায়। You may request a withdrawal once your balance reaches the minimum published in the app.
• প্রতিটি অনুরোধ যাচাই করা হয়। যাচাইয়ের জন্য পরিচয়ের প্রমাণ চাওয়া হতে পারে। Every request is reviewed. We may ask for proof of identity as part of that review.
• পরিশোধ মাধ্যমের নম্বর সঠিক দেওয়ার দায়িত্ব আপনার। ভুল নম্বরে টাকা চলে গেলে তা ফিরিয়ে আনার দায়িত্ব আমাদের নয়। Providing a correct payout account is your responsibility. We are not responsible for recovering funds sent to an account number you entered incorrectly.
• নিচের ক্ষেত্রে উত্তোলনের অনুরোধ বাতিল করার অধিকার আমাদের থাকবে: প্রতারণা, একাধিক অ্যাকাউন্ট, নিজের অ্যাকাউন্টে নিজে উপহার পাঠানো, চুরি করা পরিশোধ মাধ্যম ব্যবহার, অথবা কমিউনিটি নির্দেশিকা গুরুতরভাবে লঙ্ঘন। We may reject a withdrawal where we find fraud, multiple accounts, self-gifting, use of a stolen payment method, or a serious breach of the Community Guidelines.
• উত্তোলনের অর্থে প্রযোজ্য কর বা সরকারি চার্জ পরিশোধের দায়িত্ব আপনার। Any tax or government charge on your earnings is your responsibility.
• অ্যাকাউন্ট নিয়মভঙ্গের কারণে বন্ধ হলে অনিষ্পন্ন উত্তোলন বাতিল হবে। If your account is closed for a breach of these terms, pending withdrawals are forfeited.

৭. আপনার তৈরি করা বিষয়বস্তু7. Content you create

আপনি যা সম্প্রচার করেন, লেখেন বা আপলোড করেন — তার মালিকানা আপনারই থাকে। তবে অ্যাপে সেটি দেখানো, সংরক্ষণ করা ও দর্শকের কাছে পৌঁছে দেওয়ার জন্য আপনি আমাদের একটি বিশ্বব্যাপী, রয়্যালটি-মুক্ত অনুমতি দিচ্ছেন। এই অনুমতি কেবল সেবাটি চালানোর কাজেই ব্যবহৃত হয়। You keep ownership of everything you broadcast, write or upload. You do, however, grant us a worldwide, royalty-free licence to display, store and deliver it to viewers. That licence is used only to operate the service.

আপনি নিশ্চিত করছেন যে আপনার প্রকাশিত বিষয়বস্তুর উপর আপনার অধিকার আছে এবং তা অন্য কারও কপিরাইট বা ব্যক্তিগত অধিকার লঙ্ঘন করে না। নিয়মভঙ্গকারী বা অভিযোগযুক্ত বিষয়বস্তু আমরা পূর্ব নোটিশ ছাড়াই সরিয়ে ফেলতে পারি। You confirm that you hold the rights to what you publish and that it does not infringe anyone's copyright or personal rights. We may remove content that breaches the rules or is the subject of a valid complaint, without prior notice.

৮. অ্যাকাউন্ট স্থগিত ও বন্ধ করা8. Suspension and termination

নিয়মভঙ্গের ধরন অনুযায়ী আমরা যেকোনো একটি বা একাধিক ব্যবস্থা নিতে পারি — বিষয়বস্তু মুছে ফেলা, লাইভ বন্ধ করা, সাময়িক নিষেধাজ্ঞা, বা স্থায়ীভাবে অ্যাকাউন্ট বন্ধ করা। গুরুতর ক্ষেত্রে (যেমন শিশু সুরক্ষা লঙ্ঘন) প্রথমবারেই স্থায়ী নিষেধাজ্ঞা কার্যকর হয়। Depending on the breach we may take one or more of these steps — removing content, ending a broadcast, a temporary ban, or permanent closure of the account. In serious cases, such as a child safety breach, a permanent ban applies from the first instance.

আপনি নিজেও যেকোনো সময় অ্যাকাউন্ট মুছে ফেলতে পারেন। তাতে জমা থাকা কয়েন, ডায়মন্ড ও উপহার হারিয়ে যাবে এবং তা ফেরত পাওয়া যাবে না। You may delete your account at any time. Doing so forfeits your coins, diamonds and gifts, and this cannot be reversed.

কোনো সিদ্ধান্তে আপনি একমত না হলে [email protected] এ আপিল করতে পারেন। আমরা পুনর্বিবেচনা করব। If you disagree with a decision, you can appeal to [email protected] and we will review it.

৯. সেবার প্রাপ্যতা9. Service availability

আমরা সেবাটি সচল রাখার সর্বোচ্চ চেষ্টা করি, তবে নিরবচ্ছিন্ন থাকার নিশ্চয়তা দেওয়া হয় না। রক্ষণাবেক্ষণ, কারিগরি ত্রুটি, ইন্টারনেট সংযোগের সমস্যা বা তৃতীয় পক্ষের সেবায় বিঘ্নের কারণে সাময়িকভাবে সেবা বন্ধ থাকতে পারে। আমরা যেকোনো সুবিধা যোগ, পরিবর্তন বা বন্ধ করার অধিকার রাখি। We work to keep the service running, but we do not guarantee it will be uninterrupted. Maintenance, technical faults, connectivity problems or third-party outages may take it offline temporarily. We may add, change or discontinue any feature.

১০. দায়ের সীমা10. Limitation of liability

অ্যাপটি "যেমন আছে" ভিত্তিতে দেওয়া হয়। আইন যতটুকু অনুমতি দেয়, ততটুকু পর্যন্ত — সেবা ব্যবহারের ফলে সৃষ্ট পরোক্ষ ক্ষতি, তথ্য হারানো, আয় হারানো বা অন্য ব্যবহারকারীর আচরণজনিত ক্ষতির জন্য আমরা দায়ী থাকব না। ব্যবহারকারীদের মধ্যে অ্যাপের বাইরে হওয়া কোনো লেনদেন বা চুক্তির দায় আমাদের নয়। The app is provided "as is". To the extent the law allows, we are not liable for indirect loss, loss of data, loss of income, or harm caused by another user's conduct. We are not responsible for transactions or arrangements users make with each other outside the app.

এই শর্তাবলির কোনো কিছুই এমন দায় বাদ দেয় না যা আইন অনুযায়ী বাদ দেওয়া যায় না। Nothing in these terms excludes any liability that cannot lawfully be excluded.

১১. শর্তের পরিবর্তন11. Changes to these terms

প্রয়োজনে এই শর্তাবলি হালনাগাদ করা হতে পারে। পরিবর্তনের পর এই পাতার উপরে নতুন তারিখ বসবে এবং গুরুত্বপূর্ণ পরিবর্তন হলে অ্যাপে জানানো হবে। পরিবর্তনের পর ব্যবহার চালিয়ে গেলে নতুন শর্তে সম্মতি ধরা হবে। We may update these terms. The date at the top of this page will change, and we will notify you in the app if a change is significant. Continuing to use the app after a change means you accept the new terms.

১২. প্রযোজ্য আইন ও ভাষা12. Governing law and language

এই শর্তাবলি বাংলাদেশের আইন দ্বারা পরিচালিত হবে এবং বিরোধ নিষ্পত্তির এখতিয়ার বাংলাদেশের আদালতের। These terms are governed by the laws of Bangladesh, and the courts of Bangladesh have jurisdiction over any dispute.
